Can You Bring CBD Oil On A Plane?

Under normal conditions about 200k Americans fly each day. And knowing how popular CBD is, that equates to thousands of CBD users who might consider flying with it. Due to newer legal status and minimal regulation, this topic may be of genuine concern to our CBD-using air travelers. So, can you bring CBD oil on a plane? And what about other CBD or hemp products? First, let’s look at the federal government’s current position on hemp and then later at TSA regulations. 

The Legal Status of Hemp per the Federal Government

Why this pertains to us, is that CBD is a hemp product. Is it a product of hemp extraction, and shares the same restrictions, including the federally allowed THC levels. Hemp’s current legal status came In December of 2018 when the federal government passed the Farm Bill. This legislation put an end to the 80-year hemp prohibition and provided details on hemp legalities. 

In short, the Farm Bill made it federally legal to grow, produce, and purchase hemp and CBD products, as long as the right policies and procedures are thoroughly followed. But, even with this legislation in place, there were reports of people being detained in our countries airports for having a federally legal hemp product in their possession. This led to the TSA updating its policies on hemp products.

According to the TSA Can You Bring CBD Oil On a Plain?

In regards to the new legal status of hemp, and to avoid any conflict with the feds, the TSA made some updates to its hemp rules. In May of 2019, the TSA updated its regulations to allow passengers to fly with Cannabis-related products as long as they are one of the following:

  1. Medical marijuana (with a license) 
  2. Hemp products that contain less than 0.3% THC (like CBD!) 
  3. FDA approved cannabis products (currently there is one approved medication) 

With these new guidelines, it is safe to say that as long as your CBD products are accurate to the label and compliant with federal regulations, you can bring CBD oil on a plane in the USA. However, we do not recommend flying internationally with CBD products due to the differences in laws wherever you are traveling.
